IDEA Complaint Decision 03-048

On November 17, 2003, the Department of Public Instruction received a complaint under state and federal special education law from XXXXX against the School District of Beloit. This is the department's decision regarding that complaint. The issue is whether the district, during the 2003-2004 school year, transferred all pupil records within 5 working days after receiving notice of a student's enrollment in another district.

The complainant maintains that a phone request for the student's records was made to a district middle school early in the fall. The complainant does not know the date of the request or who made the request. Neither the requesting school district nor the School District of Beloit is able to recall or document the date of a request for this student's records previous to October 10, 2003. On October 10, 2003, the School District of Beloit received a phone request for the pupil's records to be sent to another Wisconsin school district. The School District of Beloit sent the records by facsimile transmission on October 10, 2003. On October 15, 2003, the student's records were mailed to the requesting district. There is no record of a written request for records. The School District of Beloit transferred the pupil's records within 5 working days of receipt of the October 10 phone request. Although the department could not confirm an error in this case, the School District of Beloit has taken steps to review with appropriate building and central office staff their communication system and documentation of request for records to ensure that pupil records are transferred within 5 working days after receiving notice of a student's enrollment in another district.
